Sex charge: Fernando Herrera, 32, of 184 Ramapo Road,
Garnerville, was indicted yesterday on a felony sex charge. He is accused of
forcing another person to perform oral sex on him inside his taxi cab Oct.
5. A grand jury charged Herrera with first-degree criminal sex act,
according to the Rockland District Attorney's Office.
Tarrytown
refuses taxi rate increase: An August 2007 request to raise taxi
fares from $4 to $5 is turned down. The same board awards village employees
with a wage increase of about 3.5 %.
On several occasions I
have notified and warned the village of unlicensed illegal taxis and of the
overcharging of taxi fares. What's done? NOTHING!

Taxi drivers extorting upwards of $6,000
yearly from unsuspecting customers fined only $50? Fair? You do the math.

June 1 2009, In mid May, I sent two decoys to take 10 taxi rides
within Tarrytown New York. 9 out
of 10 times, they were overcharged as much $1 to $3. Tarrytown
Administrator Michael Blau sends me a letter claiming "the Police
department used undercover officers from other communities to
investigate overcharging of customers and in not one occasion was an
officer overcharged.
Taxi rates in Tarrytown are set and regulated by the village at $4 and $1
each additional person. Some persons have been charged $20!
For the past 16 years, my livelihood as a taxi
driver and owner has been crippled by the continued politics and careless
regulating of the taxi industry by the village of Tarrytown and the
Tarrytown Police Department. What is it that causes the village of Tarrytown to not enforce ANY laws
in the only industry it truly regulates?
Why does the village of Tarrytown claim "we've received no complaints"
for taxi customers being overcharged? The reason is because the complaint system
has been a failure due to;
- Complaint stickers are allowed to be placed out of sight, to reduce or
eliminate complaints.
- Driver's taxi permits or "hack" licenses are not on display.
- Price stickers on the exterior of taxis are too small, not readable.
Actual law from the village of Tarrytown code:
273-12. Schedule of rates; display; disputes.

A taxicab owner or driver or a livery owner or driver shall not charge a fare for taxicab services or
livery services in excess of the schedule of rates established by the
Board of Trustees. The schedule of rates is located in the
Fee Schedule for the Village of Tarrytown.
(people are overcharged everyday). |

A card listing the zones and the fee schedule shall be
placed in each taxicab or livery in a clearly visible location as
prescribed by the Police Committee. (doesn't
exist) |
| C. |
In the event of a dispute over the fare, the driver
shall contact the dispatcher; if requested by the passenger, the driver
shall proceed to the police station.

| D. |
The Board of Trustees may, by resolution, modify the
schedule of rates. (these guys charge whatever
they want anyway) |
| E. |
A card advising the taxicab/livery passenger that
complaints regarding service and/or rates can be directed to the Village
of Tarrytown Police Department shall be placed in each taxi and livery vehicle
at a location determined by the Police Committee. (Not found in most taxis) |
Taxis park overnight in the residential areas of
Tarrytown and Sleepy Hollow. These are commercial vehicles according to the
Tarrytown code below. Take a look at number 6 and 7 below.
291-1. Definitions
and word usage; official time standard.

The words and phrases used in this chapter
shall, for the purposes of this chapter, have the meanings respectively
ascribed to them by Article I of the Vehicle and Traffic Law of the
State of New York. |

The following words and phrases, which are
not defined by Article I of the Vehicle and Traffic Law of the State of
New York, shall have the meanings respectively ascribed to them in this
section for the purposes of this chapter: |

COMMERCIAL VEHICLE [Amended 7-21-1997
by L.L. No. 7-1997] Any motor vehicle used for business or
commercial purposes, including any trailers and semitrailers, tractors,
when used in combination with trailers and semitrailers, and:
| (1) |
Weighing more than 6,000 pounds; or |
| (2) |
More than 20 feet in length; or |
| (3) |
More than eight feet in width; or |
| (4) |
Bearing advertising on the vehicle, including but
not limited to the name of the business, telephone number or hours
of operation; or |
| (5) |
Carrying tools or equipment attached to the outside
of the vehicles or carrying tools or equipment visible from outside
of the vehicle; or |
| (6) |
Bearing a livery license;
or |
| (7) |
Bearing a taxi license. |

291-23. Night parking.
| A. |
Motor vehicles other than
commercial vehicles may be parked on any streets or highways within the
Village during any hours of the day or night, if otherwise
permitted by law, including the period between 1/2 hour after sunset and
1/2 hour before sunrise, without displaying any lights either in front
or at the rear of such vehicles. |
| B. |
The parking of commercial
vehicles on the streets of the Village is limited to one hour between
9:00 p.m. and 8:00 a.m. unless further restricted by 291-24,

It shall be unlawful to park a commercial vehicle or a noncommercial trailer in a residential
area, unless said vehicle is engaged in the process of
delivery or the conducting of business to a premises in said residential
area or said vehicle, to a maximum of two vehicles, is stored in an
enclosed garage or screened completely from the street and abutting
residences as determined by the Building Inspector. |
| B. |
One vehicle bearing a commercial plate but not falling
within the definition of commercial vehicle as defined in this section may be parked in a driveway in a
residential area. |

the village rate sticker enabling him to overcharge people
and park in a residential area overnight.
